Rules and Regulations

HOW TO ENTER

1. To be eligible to win a prize, go online to www.nestle.ca and complete the Nestlé What's Your Twist entry form. Once you have completed all of the mandatory fields click on "Submit" and you will automatically be entered into the contest. The contest is open to all legal residents of Canada. Participants under the age of majority in their province / territory of residence, will need to obtain parental or legal guardian permission, have read the rules and regulations and have indicated so by checking the box on the contest entry form. As a condition of entry, all contestants must consent online to one of the following two statements below:

I have read and understand the contest rules and regulations, and am over the age of majority in my province of residence.

I have read and understand the contest rules and regulations, and confirm that the entrant is my child/ward, and that he/she has my consent to enter this contest.

This Contest starts on Tuesday, June 1, 2010 at 12:00:01 AM ET and ends on Tuesday, May 31, 2011 at 11:59:59 PM ET. There are 12 contest periods. In order to be eligible, entries for each contest period must be received between the first day of each month and the last day of the same month. Entry forms received after the last day of the month will be automatically entered in the next contest period. In the event that there are no eligible entries received in a contest period, no Prizes will be awarded for that contest period.

2. On the last day of every contest period or the first business day thereafter if the last day falls on a weekend, Nestlé Canada Inc. at 25 Sheppard Ave. W., North York, Ontario, will select two (2) Nestlé What's Your Twist entry forms from all entry forms received during that contest period. To qualify as a Nestlé What's Your Twist, the idea submitted must be about a cool new product, an original new service or an exciting new packaging for an existing product. A panel will select the two (2) best ideas from each contest period. The entry forms chosen will be eligible to win a prize. The prizes must be accepted as awarded, have no cash equivalent and are not transferable or refundable. Approximate Retail value of each prize is $40.00 CDN.

GENERAL

3. Entrants selected as eligible to receive a prize will be notified by telephone within two weeks of the monthly draw dates. Nestlé will only notify the winners of a prize.

4. This contest is conducted by Nestlé Canada Inc. and is open to all residents of Canada. All entrants who have not reached the age of majority at the time of this contest must have the consent of his/her parent or legal guardian to submit their idea. This contest excludes employees (including persons with whom they are domiciled) of Nestlé Canada Inc., participating retail locations, their respective agents or representatives, their respective advertising and promotional agencies and the contest judges. Submissions through groups and/or charities will not be accepted.

5. None of Nestlé Canada Inc., participating retail locations, or their respective agents or representatives shall be responsible in any way for the use of or bear any liability whatsoever in any way attributable to the prize awarded in this contest.

6. All entry forms become the property of Nestlé Canada Inc. for any and all purposes and will not be returned. Entries received that are incomplete, inaccurate, forged, irregular in any way, contain a nickname or fictitious name, contain any typographical, printing or other errors including the use of swear words or otherwise are not in compliance with these contest rules will be declared void by the Sponsor in its sole discretion.

7. By accepting a Prize in this contest, a Prize Winner and, if under the age of majority, his/her parent or legal guardian agree to hold Nestlé Canada Inc., their affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of or in any way connected with the operation of this contest and use of a Prize. Prize Winners and, if under the age of majority, his/her parent or legal guardian assume all liability for any injury or damage caused, or claimed to be caused, by participation in this contest or use or redemption of a Prize. By participating in this contest, entrants agree to be bound by the Official Contest Rules and Regulations and the decisions of the Contest judges as selected by Nestlé Canada Inc. All ideas submitted become the property of Nestlé Canada without payment of any compensation in addition to the prize award to successful entrants.

8. Nestlé Canada Inc. retains the right, in its absolute discretion, to make substitutions of equivalent kind or value in the event of the unavailability of any component of the selected prize for any reason whatsoever. Only one (1) prize per household or address or e-mail address will be awarded.

9. This contest is subject to all Federal, Provincial and Municipal laws. Decisions of Nestlé Canada Inc. are final with respect to all aspects of this contest.

10. Entry forms shall be subject to verification and shall be null and void if they are not obtained in accordance with these contest rules.

11. The right is reserved to withdraw or terminate this contest, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, at any time without prior notice.

12. By entering the contest, entrants, if under the age of majority, his/her parent or legal guardian, consent to the use of their name, address (city and province) and/or likeness, without further compensation, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised, including the Internet, in any publicity or advertising carried out by the Sponsor relating to the contest.

13. All ideas submitted become the property of the Nestlé Canada Inc., without payment of any compensation.

14. For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
